Overview
These Terms of Sale govern all purchases made through www.darksails.fr. By placing an order, you agree to these Terms without reservation.
Section 1 - Seller

Section 2 - Products
We make every effort to accurately represent our products through descriptions, photographs, and dimensions. However, colours and finishes may vary slightly depending on your screen and its settings.
Darksails products are handcrafted. Minor variations between pieces are inherent to artisanal production and do not constitute defects.
We reserve the right to modify or discontinue any product at any time without notice.
Section 3 - Orders
When you place an order, you are making an offer to purchase. Your order is accepted only upon receipt of your order confirmation email and successful payment processing. We reserve the right to refuse or cancel any order at our discretion.
Please review your order carefully before submitting — cancellations after acceptance are not guaranteed.
If we refuse or cancel your order, we will notify you by email and issue a full refund promptly.
Section 4 - Prices and payment
Prices are in euros, inclusive of applicable taxes (VAT not applicable, Art. 293 B CGI). Shipping costs are shown separately before order confirmation.
Prices are subject to change without notice. The price applicable to your order is the one shown at the time of purchase, as confirmed in your order confirmation email.
You warrant that the payment information you provide is accurate and that you are authorised to use the payment method provided.
Section 5 - Delivery and risk of loss
Delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by carriers, customs, or events outside our control.
In accordance with applicable French consumer law, risk of loss or damage transfers to you — or to the third party you designate — at the moment physical possession of the parcel is taken. We remain responsible for ensuring proper delivery until that moment.

Section 6 - Errors and omissions
Despite our best efforts, errors in pricing, descriptions, or availability may occasionally occur. We reserve the right to correct any such errors at any time, including after an order has been placed. Where applicable, we will inform you and offer the option to cancel or adjust your order.
Section 7 - Legal guarantees
Under French consumer law, all our products are covered by the following statutory guarantees:
Legal guarantee of conformity (Art. L.217-3 et seq. of the French Consumer Code): 2 years from delivery. If your product is defective or does not match its description, you may request repair, replacement, or a refund.
Guarantee against hidden defects (Art. 1641 et seq. of the French Civil Code): if a hidden defect existing at the time of purchase renders the product unfit for its intended use, you may request cancellation of the sale or a price reduction.
These statutory guarantees apply regardless of any commercial warranty we may offer.
Section 8 - Limitation of liability
To the fullest extent permitted by applicable law, we shall not be liable for indirect, incidental, or consequential damages arising from the use of our services.
This limitation does not apply to:
- Personal injury or death caused by our negligence
- Fraud or wilful misconduct
- Any liability that cannot be excluded under French law
The statutory rights of French consumers, including those arising from legal guarantees, are preserved in all circumstances.
Section 9 - Force majeure
We shall not be liable for any delay or failure to perform resulting from events beyond our reasonable control within the meaning of Article 1218 of the French Civil Code, including natural disasters, pandemics, carrier strikes, major network disruptions, or any other unforeseeable, unavoidable event.
In the event of force majeure, we will inform you as soon as possible and seek an appropriate solution (extended deadline or full refund if fulfilment is impossible).
Section 10 - Indemnification
You agree to indemnify and hold Darksails harmless from any claims, damages, or costs arising from your breach of these Terms or violation of applicable law.
Section 11 - Severability
If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions shall continue in full force and effect.
Section 12 - Governing law and jurisdiction
These Terms are governed by French law. Any disputes shall be subject to the jurisdiction of the competent courts of Bordeaux, France.
For EU consumers: these provisions do not limit your right to bring proceedings before the courts of your country of residence under European consumer protection law.
Section 13 - Consumer mediation
In accordance with Article L.612-1 of the French Consumer Code, if a dispute cannot be resolved amicably, you may contact our consumer mediator free of charge:

Section 14 - Changes
We reserve the right to update these Terms at any time. The version in effect at the time of your order applies.
